Equivalence exists in both systems, on different terms
Annex XIV of the MDR allows a clinical evaluation to be based on clinical data relating to a device for which equivalence can be demonstrated, taking technical, biological and clinical characteristics into account together. The differences must not have a clinically significant effect on safety or clinical performance, and the justification has to be scientific and supported by sufficient access to data. It is an argument to be built, not a shortcut.
